About Equipment Used in Construction Projects
In accordance with the provision in subparagraph (d) of the first paragraph of Article 63 of the Public Procurement Law No. 4734, which stipulates that all or a certain part of the machinery, materials, equipment, and software to be used in construction works must be domestically produced, the regulations for the implementation of the said article are given in the annex to the Construction Works Tender Implementation Regulation.
Recently, industry representatives have stated that they are experiencing problems in practice regarding the use of domestically produced machinery, materials, equipment, and software in construction projects. They have received complaints alleging that documentation is not being prepared in accordance with the Law and secondary legislation, or that inspections by the administration during the contract phase are insufficient. To address these issues, it has been stated that the Public Procurement Authority has prepared a draft regulation amending the Regulation on the Implementation of Construction Procedures.
